Project Developing an EU Training Module for the Victims' Directive

Objetivo: O projeto tem por objetivo desenvolver um modelo de formação destinado a magistrados, advogados, e outros profissionais do sistema judicial sobre os direitos e as necessidades das vítimas de crime, à luz do Artigo 25 (3) da Diretiva 2012/29/EU que estabelece normas mínimas relativas aos direitos, ao apoio e à proteção das vítimas da criminalidade: “no devido respeito pela independência da profissão jurídica, os Estados-Membros devem recomendar que os responsáveis pela formação dos advogados lhes prestem formação geral e especializada a fim de aumentar a sua sensibilização em relação às necessidades das vítimas” e “sem prejuízo da independência do poder judicial e das diferenças de organização dos sistemas judiciais da União, os Estados-Membros devem solicitar que os responsáveis pela formação dos juízes e dos procuradores que intervenham em processos penais lhes prestem formação geral e especializada a fim de aumentar a sua sensibilização em relação às necessidades das vítimas”. Pretende-se que a formação destes profissionais sobre as disposições da Diretiva das Vítimas venha a contribuir para o sucesso da implementação deste instrumento jurídico. Procura-se ainda que a formação, acompanhamento e partilha de metodologias e boas práticas seja um veículo de sensibilização para os direitos que são consagrados às vítimas na referida Diretiva. O projeto irá ainda contribuir para a promoção do acesso das vítimas ao sistema de justiça penal, uma vez que se focará na formação dos stakeholders que têm um papel-chave na implementação da Diretiva.

Objective: the project aims at developing a training module targeted to prosecutors, lawyers and other criminal justice system professionals on the rights and needs of victims of crime, in light of Article 25 (3) of the Directive 2012/29/EU establishing on the rights, support and protection of victims of crime: “with due respect for the independence of the legal profession, Member States shall recommend that those responsible for the training of lawyers make available both general and specialist training to increase awareness of lawyers of the needs of victims” and “without prejudice to judicial independence and differences in the organisation of the judiciary across the Union, Member States shall request that those responsible for training of judges and prosecutors involved in criminal proceedings make available both general and specialist training to increase the awareness of judges and prosecutors of the needs of victims”. It is envisaged that the training to these professionals on the dispositions of the Victims Directive may contribute to the successful implementation of this legal instrument. It is also aimed that training, monitoring and best practices sharing may be prone to raise the awareness on the rights granted to victims in the mentioned Directive. The project will also contribute to promoting victims access to the criminal justice system, since it will focus on the training of key-stakeholders to the implementation of the Directive.
